The website www.fromages-sciboz.ch is accessible by the Customer 24 hours a day, 7 days a week and all year round, except in the case of maintenance operations.

The BUYER is the CLIENT;

BUYERS must be at least 18 years of age, have the legal capacity to contract.

ARTICLE 1: GENERAL CONDITIONS OF SALE:

Any online order implies the acceptance by the CUSTOMER of these General Conditions of Sale (CGV) without reservation.

ARTICLE 1.1 PURPOSE OF THE GTC

The purpose of these Terms and Conditions is to define the rights and obligations of the parties in connection with the on-line sale of goods offered by the SELLER to the BUYER.

The GTCs present the entire obligations of the parties concerning the ordering of a "BASKET".

ARTICLE 1.2 ACCEPTANCE OF TERMS AND CONDITIONS

The BUYER unreservedly validates the contents of the GTC at the time of each Order.
 

ARTICLE 1.3 MODIFICATION OF GTC

The SELLER may modify the general conditions from time to time. They will be applicable as soon as they are put on line.
 

ARTICLE 1.4 APPLICATION OF GTC

The conditions applicable to the sale are the GCS in force at the time of the Order.

They are known and recognized by the BUYER.

If one or more of the provisions of these General Terms and Conditions are held to be invalid or declared to be invalid under any law, regulation or as a result of a final decision of a competent court, the remaining provisions shall retain their full force and their scope.

The fact that one of the parties does not avail itself of a failure by the other party to any of the obligations referred to in these general conditions can not be interpreted for the future as a waiver of the obligation in question.

ARTICLE 2: PERSONS BOUND BY THE ONLINE CONTRACT

ARTICLE 2.1: THE SELLER

The SELLER is Fromagerie Sciboz • Bd de perocles 18A • CH-1700 Friborg - Switzerland

The SELLER proposes to buy a BASKET of fresh products consisting of cheeses and / or accessories.
 

ARTICLE 2.2: THE PURCHASER

A person becomes a BUYER by validating the order of a BASKET.

BUYER

- declares to be at least 18 years old,

- states that he has the legal capacity to contract

The BUYER declares these characteristics established, it guarantees to be qualified to be able to place the order on the site.

The BUYER acknowledges to know the CGV established on the day of the order by clicking on «validate my order» and by ticking the box «I accept the General Conditions of Sale».

The SELLER and the BUYER agree that these general conditions govern exclusively their relationship on the deed of sale of a "BASKET".
 

ARTICLE 3: FRESH PRODUCTS SUBMITTED ONLINE:

ARTICLE 3.1 ABSENCE OF RIGHT OF WITHDRAWAL

The right of withdrawal is excluded for the sale of BASKETS of Fresh Products which, by their nature, can not be redirected or can deteriorate or die quickly.

ARTICLES 3.2 PRESENTATION OF PRODUCTS

The products are described and presented with the greatest possible accuracy. The photographs of the products are not contractual.

The fresh products provided will have a different appearance from the photographs on the site.

Seller's liability can not be incurred if errors or omissions may have occurred in connection with this presentation.
 

ARTICLE 3.3 FOOD ALLERGIES

The SELLER is not responsible for the declaration of a food allergy of the BUYER. The BUYER is alone in knowing the use that will make of the products bought and only to know the food allergies recognized towards him.



ARTICLE 4: CONTRACT BINDING THE PARTIES

The SELLER offers an offer to order cheeses and accessories on the site.

The BUYER makes an order and pays the order online.

Validation of an order means a payment obligation of the BUYER. This validation is conditional on an actual payment.

The transaction consists of a sale under the following conditions: ordering a SHOPPING CART, paying online, preparing the order and sending the order by Swiss Post.


ARTICLE 4.1 ONLINE SALES

The Purchase consists of several operations:

- the preparation of an order of Products by the SELLER,

- immediate payment of the sale price by you as BUYER,

- Shipping of the order by Swiss Post

The Buyer is informed that the cheeses are cut by hand, and that there may be a difference of plus or minus 10%.


ARTICLE 4.2 DELIVERY POLICY

The PRODUCTS will be sent to the delivery address (es) that the CLIENT will have indicated during the ordering process.

ARTICLE 5: CONDITIONS TO PERFORM AN ORDER

ARTICLE 5.2: DURATION OF THE OFFER AND AVAILABILITY OF THE PRODUCTS

Offers are valid for the duration of their posting online, and within the limit of available stocks.
 

ARTICLE 6: TERMS OF THE ORDER

The BUYER will confirm the order of a BASKET by clicking on "Validate my order". He will be offered a summary of his entire order. He will thus be able to verify the detail of his order.

The BUYER will have the choice of payment methods. He will make his online payment which is mandatory. The site will authorize the validation of the order when the payment has been settled and confirmed by the banking system.

The sale will be concluded as of that moment. The BUYER will receive a confirmation email including the order details and the order form.


ARTICLE 7: TERMS OF PAYMENT

The price invoiced to the CUSTOMER is the total price including taxes indicated on the confirmation of order sent by the SELLER.

All orders are payable in Swiss francs, immediately, by credit card, on the site of the Seller's banking partner in a secure environment. Credit cards accepted are the traditional cards as indicated on the payment site.
 

ARTICLE 8: PERSONAL INFORMATION AND PROTECTION OF PROFESSIONAL DATA CUSTOMER SERVICE

The information and data provided by the Customer and collected by the Seller on the website (such as his surname, first name, contact details and details of his orders) are treated confidentially and are stored in one or more centralized databases at the level of the Seller.

The Customer's personal data requested by the Vendor, responsible for processing, are necessary for the recording, monitoring and archiving of his orders, the commercial and marketing management of his file and the quality of his relations with the Seller.

The Customer's personal information and data are also kept by the Seller for security purposes in order to comply with legal and regulatory obligations and to allow the personalization of the services offered and the information addressed to the Customer by the Seller.
